These Terms and Conditions ("Terms") govern your access to and use of the website operated by NYYNE ("NYYNE", "we", "us", "our") and every purchase made through it. By browsing the site, creating an account, connecting a wallet or placing an order you agree to be bound by these Terms, our Privacy Policy, our Cancellation & Refund Policy and our Shipping & Exchange Policy. If you do not agree, please do not use the site.
1. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to purchase from this site. By ordering you confirm that the information you provide is accurate and that you are authorised to use the payment method or wallet you supply.
2. Products, pricing and availability
- Catalogue prices are listed in US Dollars (USD) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. An indicative Indian Rupee (INR) equivalent is displayed for convenience; where payment is collected through Razorpay the amount is charged in INR at the conversion rate shown at checkout.
- Prices, specifications and availability may change without notice. Obvious pricing or typographical errors may be corrected, and we may cancel and fully refund any order affected by such an error before dispatch.
- Collectibles and limited editions are numbered and strictly limited to the stated supply. Physical products are made in small batches; colour and texture may vary slightly from screen images because of fabric dye lots and screen calibration. Such variation is not a defect.
- Certain products are token-gated and may only be purchased by accounts that hold the required collectible or loyalty balance. Eligibility is checked at the time of order.
3. Custom and made-to-order products
Launch boxes, personalised items and any product that is configured, branded, printed, embroidered or otherwise produced to a customer's specification ('Custom Products') are manufactured only after you confirm the brief and quotation. Custom Products are produced exclusively for you and cannot be resold. Accordingly, Custom Products are non-cancellable once production has begun and non-returnable, except where the product is defective or materially different from the approved specification (see our Shipping & Exchange Policy). You are responsible for the accuracy of artwork, logos, spellings, quantities and sizes approved by you, and you warrant that you own or are licensed to use all artwork you supply.
4. Orders and acceptance
Your order is an offer to buy. A contract is formed only when payment is successfully captured and we send an order confirmation. We may refuse or cancel any order for reasons including suspected fraud, unavailability, pricing error, or inability to verify payment, in which case any amount paid will be refunded in full.
5. Payment
- We accept card payments, UPI / net-banking and wallets through Razorpay, and cryptocurrency payments where offered. Payments are processed by regulated third-party payment gateways; we do not store your card details.
- Cryptocurrency payments are irrevocable once confirmed on-chain. The INR/USD value recorded for a crypto payment is determined at the time the transaction is confirmed and is used for your tax invoice. Network (gas) fees are borne by you. You are solely responsible for any tax or regulatory obligations arising in your jurisdiction from paying in cryptocurrency.
- A GST tax invoice is issued electronically for every paid order. Business buyers who require a B2B invoice must enter a valid GSTIN at checkout; we cannot amend an invoice after it has been issued.
6. Digital products and collectibles
Digital downloads and collectibles are delivered to your account immediately after payment and are therefore non-refundable once delivered. Collectibles recorded on our platform or on a blockchain testnet/mainnet confer the rights described on the product page only; they do not constitute securities, investments or a promise of future value. Loyalty points have no cash value, are non-transferable and may be adjusted or withdrawn in the event of refund, chargeback or misuse.
7. Accounts and wallets
You are responsible for safeguarding your login credentials, wallet keys and recovery phrases. We will never ask for them. Activity performed through your account or wallet is deemed to be yours.
8. Intellectual property
All content on this site — including designs, photographs, text, logos, patterns and the NYYNE name — is owned by or licensed to NYYNE and protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws. Purchasing a product does not transfer any intellectual property rights in its design.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from an order shall not exceed the amount paid for that order. We are not liable for indirect, incidental or consequential loss, for delays caused by carriers, customs or events beyond our reasonable control, or for losses arising from your use of cryptocurrency networks or third-party wallets.
10. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the Consumer Protection Act, 2019, the courts at our registered place of business shall have exclusive jurisdiction over any dispute.
11. Changes
We may update these Terms at any time by posting the revised version on this page. Continued use of the site after a change constitutes acceptance.
12. Grievance officer
In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, grievances may be addressed to our Grievance Officer at the email address on our Contact page. We aim to acknowledge complaints within 48 hours and resolve them within 30 days.
